37,000 Nail Gun Injuries a Year, and the Trigger Design Doubles the Risk

Nail guns send roughly 37,000 people to emergency rooms every year, about two-thirds of them workers, according to the joint OSHA and NIOSH guidance on nail gun safety.[1] The single biggest variable is the trigger. A contact trigger fires whenever the nose touches a surface while the trigger is held, which enables fast "bump nailing" and also enables double-fires, discharges from bumping a leg on the way up a ladder, and nails through the off-hand. A full sequential trigger requires the nose to be pressed first, then the trigger pulled, one nail per cycle.
The research behind the federal guidance puts the injury rate for contact-trigger nailers at roughly twice that of sequential triggers doing the same work. That number does a lot of legal work, because it converts "the gun went off" from an act of God into a foreseeable, quantified consequence of a known design choice: the manufacturer that sold it, the contractor that issued it, and the site that tolerated bump-firing near other workers all made that choice with the data available.
The recurring patterns in our intake are consistent with the studies: double-fires into the holding hand, discharges while climbing with the trigger squeezed, nails passing through lumber into a coworker, and ricochets off metal connectors. Awkward-position work and framing account for the worst of them.
When the Tool Is the Defendant: Product Claims for Guns, Saws, and Grinders
A tool injury becomes a product liability case when the design, the guarding, or the warnings failed the user. Nail guns with triggers that can be converted to bump-fire in seconds. Saws sold without flesh-detection braking long after the technology was practical. Grinders whose guards vibrate loose, wheels that shatter above their rated speed, powder-actuated tools that fire through substrates into the space beyond. The manufacturer's own manuals, patents, and safer-alternative designs become the evidence, and none of it depends on proving your employer did anything wrong.
The Tool Goes in a Box, Not Back in the Trailer
Every product case begins with the same act: preserving the tool, unrepaired and unaltered, with its fasteners, battery or hose, and settings exactly as they were. A nailer that goes back into service is a case that mostly evaporates, because the trigger setting, the wear, and any modification are the proof. Photograph it, bag it, and note who owned and maintained it. The maintenance and rental history can matter as much as the design: a rental house that kept renting a saw with a missing guard owns a share of what the saw did.
OSHA's construction tool rules frame the jobsite half of the case: power tools must be guarded per 29 CFR 1926.300, pneumatic tools secured to their hoses, and powder-actuated tools operated only by trained workers with daily testing.[2] A site where guards came off "to get the work done" is a site whose supervision failed, and that failure has an address above the worker who got hurt.
Beyond Workers' Comp: Who Else Answers for a Tool Injury
If the tool was defective, the manufacturer and seller answer in product liability regardless of comp. If a coworker from a different company fired the nail or removed the guard, that company answers in negligence. If a rental company supplied the tool in dangerous condition, the rental agreement and inspection records carry the claim. These distinctions decide the size of the recovery. Comp pays medical care and partial wages. The product and third-party claims pay for the hand that no longer closes, the career change nobody planned, and the pain that outlasts the treatment, which is why a nail through the hand deserves more legal analysis than an incident report and a tetanus shot.
