A South Bay Injury Claim Is Heard Downtown and Often Involves the Border
An injury claim from Chula Vista, National City, Imperial Beach, San Ysidro, or Otay Mesa is decided under California law and, if it goes to court, heard at the Hall of Justice in downtown San Diego.
The South County courthouse on Third Avenue in Chula Vista takes civil restraining orders only.
Chula Vista and National City police write the reports on their own streets, the San Diego Police Department covers San Ysidro and Otay Mesa, and the CHP covers the freeways.
A claim against a city, MTS, or Caltrans needs a written government claim within six months.
Crashes with drivers insured in Mexico, and with Navy vehicles from Naval Base San Diego, follow rules of their own.
Most other injury lawsuits must be filed within two years.

Who Wrote the Crash Report and Where a South Bay City Claim Goes
The South Bay is three cities and two neighborhoods of the City of San Diego, and each has its own police agency and its own claim office.
| Where it happened | Who writes the crash report | Claim against the local government |
|---|---|---|
| Chula Vista | Chula Vista Police Department on city streets; the CHP on I-5, I-805, SR-54, and SR-125 | Online, or on the Claim for Damages form to the Office of the City Clerk, 276 Fourth Avenue, in person or by mail; processed by the City Attorney's Office[1] |
| National City | National City Police Department on city streets; the CHP on I-5, I-805, and SR-54 | The City Clerk at City Hall, 1243 National City Boulevard |
| Imperial Beach | The San Diego County Sheriff's Department, under the city's contract[2] | The City of Imperial Beach, which takes its own claims |
| San Ysidro and Otay Mesa | San Diego Police Department; the CHP on I-5, I-805, and SR-905 | City of San Diego Risk Management, through its Public Liability portal or form RM-9 |
| MTS Blue Line trolley and South Bay buses | The police agency where it happened | The MTS Claims Administrator, not the city |
Each city is its own public entity, so a claim filed with Chula Vista does not reach National City, and neither reaches MTS or Caltrans. A crash at an intersection with a failed signal and a bus involved can need two or three claims, each due within six months.
The county's other claim offices and the rules for what a claim must say are on our page about filing an injury claim in San Diego County.
Crashes Involving Border Traffic From San Ysidro and Otay Mesa
"San Ysidro was the busiest land port in the United States for people entering the country in 2025, at about 33 million."
Federal border data counted about 33 million people entering at San Ysidro in 2025, by car, on foot, and by bus or train, and 990,111 commercial trucks entering at Otay Mesa, second only to Laredo on the Mexican border.[3]
Drivers insured in Mexico
A Mexican policy can count in California for a car registered outside the state when the insurer has filed a power of attorney with the DMV. A policy that does not cover U.S. driving, or an insurer that denies the claim, leaves the car uninsured under California's definition, and your own uninsured motorist coverage becomes the route, as our page on crashes with drivers insured in Mexico explains.
Commercial trucks from the Otay Mesa crossing
A Mexico-domiciled carrier must carry insurance from an insurer authorized in a U.S. state, at least $750,000 for general freight, with proof aboard each truck. The carrier, the broker, and the companies that handled the load are covered on our page about truck accident claims in San Diego.
After a crash near the border, the other driver's insurance card, registration, and license are the documents that settle which coverage applies.
Navy Vehicle Crashes and the Federal Claim They Require
Naval Base San Diego, on the National City line, counted 33,764 active-duty and civilian personnel in fiscal year 2025, and Naval Base Coronado, whose nine installations include Outlying Field Imperial Beach and Naval Training Site Otay Mesa, counted 30,015.[4]
- A service member or federal employee on duty: a claim against the United States, starting with Standard Form 95 to the right agency within two years
- A service member off duty in a personal car: an ordinary California claim against that driver and their insurance
- A government-owned vehicle: your uninsured motorist coverage does not apply to it
- A contractor's truck: a claim against the contractor and its insurer, outside the federal process
The federal claim, its dollar figure, and its deadlines are explained on our page about crashes with military and federal vehicles.
Trolley, Bus, and E-Bike Injuries in Chula Vista and National City
The MTS Blue Line runs through National City and Chula Vista to the border at San Ysidro, and MTS counted 81.2 million boardings systemwide in fiscal year 2025. An injury on the trolley, at a station, or on an MTS bus is a claim against MTS, due within six months, even when it happens on a city street.
Chula Vista was among the first cities to adopt the under-12 rule for class 1 and class 2 e-bikes, in July 2025, under the San Diego County pilot program in Vehicle Code § 21214.7. Across the county, e-bike crashes sent people to emergency rooms 865 times in 2024 and led to 186 hospital admissions, according to the County's health advisory.[5]
When a driver hits a child on an e-bike, the claim turns on how the crash happened. If the child was riding in violation of a local rule, expect the other side to raise it as comparative fault, which reduces a California recovery by a percentage rather than ending it. A child's settlement also needs a judge's approval.
Seriously Injured Adults Go North to Level I Trauma Centers in Hillcrest
None of San Diego County's six designated trauma centers is in the South Bay.[6] A seriously injured adult goes to a trauma center outside the South Bay, such as the Level I centers at Scripps Mercy Hospital and UC San Diego Medical Center in Hillcrest, and a child to Rady Children's Hospital.
- Scripps Mercy Hospital Chula Vista and Sharp Chula Vista Medical Center are private hospitals, so a malpractice claim starts with the 90-day notice and the one-year deadline
- UC San Diego Health is public but exempt from the six-month government claim
- An emergency hospital stay can bring a hospital lien, which California law caps at 50 percent of what remains after prior liens
Who owns each hospital, and what that means for a malpractice claim, is laid out on our page about medical malpractice claims in San Diego.
How Much Is a Chula Vista Personal Injury Claim Worth?
The value of a Chula Vista claim starts with the injury itself, the medical bills, the lost work, and the pain, and then depends on which policies will pay, which near the border can be the harder question.
- The injury and the care it will need, including surgery and lasting limits on work
- The other driver's coverage, which may be a $30,000 minimum policy or a Mexican policy that may not apply
- Your own uninsured and underinsured motorist coverage, which can decide how much is collectible when the other driver's coverage is thin or does not apply
- Your own insurance status, since Proposition 213 bars pain-and-suffering damages for a driver who was uninsured
California sets no cap on pain-and-suffering damages outside medical malpractice, so the practical ceiling on a claim is the insurance available.
Six Months for a City Claim and Two Years to Sue
Most injury lawsuits in California must be filed within two years under Code of Civil Procedure § 335.1.[7]
- Six months for a written claim against Chula Vista, National City, Imperial Beach, the City of San Diego, MTS, or Caltrans
- Two years to present a federal claim after a crash with an on-duty service member
- Two years to settle, sue, or start arbitration on your own uninsured motorist claim
- One year from discovering a medical injury, for most malpractice claims
A child's lawsuit against a private party is generally paused until age 18, but the six-month government claim is not, as our page on California injury filing deadlines explains.
In the South Bay, a single crash can involve a city street, an MTS bus, and a driver from Mexico, and each one adds its own clock.
