    July 2026: Where the Hernia Mesh Litigation Stands

    The Bard MDL (MDL 2846, Southern District of Ohio) still listed 23,695 pending actions on the JPML's March 2026 report, most of them working through settlement administration rather than heading to trial. New Bard claims continue to be filed. The Atrium C-QUR litigation (MDL 2753, District of New Hampshire) has been resolved through a confidential settlement, with a court-approved qualified settlement fund paying eligible claimants.

    February 2026: First Covidien Bellwether Trial Date Vacated

    The first bellwether trial in the Covidien Parietex litigation (MDL 3029, District of Massachusetts) had been set for February 2026 before the court vacated the date. Roughly 2,300 Covidien cases remain pending, and pretrial work continues toward a new trial setting. Covidien is now the active litigation track for hernia mesh claims.

    October 2024: Bard Settlement Framework Announced

    Becton Dickinson, the parent company of C.R. Bard and Davol, announced a settlement framework reported to exceed $1 billion, covering more than 38,000 hernia mesh claims. Compensation is allocated through a points-based system tied to injury severity, and payments are processed in order of filing date.

    November 2023: Third Bellwether Verdict for the Plaintiff

    In Stinson v. C.R. Bard, the third bellwether trial in MDL 2846, the jury awarded the plaintiff $500,000 on negligence and failure-to-warn claims involving the PerFix Plug. The first bellwether had ended in a defense verdict and the second, Milanesi v. C.R. Bard, in a $255,000 plaintiff verdict.
