How Much Is a Personal Injury Case Worth in Miami?
Whatever the evidence proves it is worth. Florida places no cap on compensatory damages in an ordinary negligence case, so the ceiling is set by your losses, not by statute.

The Rules That Decide Miami-Dade Injury Claims
Two years to file. Most negligence claims must be filed within two years under § 95.11.[2] Wrongful death runs two years from the date of death. Medical malpractice adds a presuit process that consumes months of that time.
The 51 percent bar. Since 2023, a claimant found more than 50 percent at fault recovers nothing.[3] Every fault percentage the adjuster proposes is now leverage, which is why the crash report, the footage, and the physical evidence get locked down before the argument starts.
No-fault comes first in car cases. Your own PIP pays the first $10,000 regardless of fault, treatment must start within 14 days, and suing the at-fault driver for pain and suffering requires a permanent injury under § 627.737(2). The system is a maze on purpose. We run it daily.
Government defendants play by their own clock. A claim against Miami-Dade County, a municipality, Metrobus, or a public hospital district runs through sovereign immunity: presuit notice, statutory caps, and waiting periods under § 768.28.[4] A crash with a county bus is a different lawsuit than a crash with a sedan, from day one.
