The media has termed the illegal software installed by VW as a "defeat device," because it is designed to defeat the measures in place to ensure all vehicles meet federal and local guidelines for pollutants.

This software detects when the vehicle is being tested for emissions and temporarily reduces the amount of nitrogen oxide emitted by the vehicle for the duration of the test.
Once the test is completed and the software detect normal road conditions, the pollution controls are automatically switched off. This gives the vehicle more power, but it also causes it to greatly exceed the acceptable level of nitrogen oxide emissions. In fact, in some cases, these cars can emit up to 40 times the legal limit of nitrogen oxide.
According to the U.S. Environmental Protection Agency (EPA.gov), the algorithm that lies at the heart of this software is "sophisticated." Based on this assessment, VW owners, lawyers and the general public alike can only assume that the devices must have been intentionally employed for the purpose of misleading tests for emissions performance.
The software analyzed a number of factors to determine if the engine control module should be running in "road calibration" or if there was a possibility the vehicle was undergoing testing for emissions output. Recalls of the affected diesel vehicles have occurred around the world, although there is currently little recourse for owners because a fix has yet to be implemented. While cars with a larger engine may require only a software update, those with the smaller 1.6-liter diesel engines must be adjusted manually, and retrofitted with new parts.
According to reports by the Associated Press (AP), it could be September 2016 before these parts are available.
In mid-October, Volkswagen announced plans to recall more than 8.5 million cars in Europe (Volkswagen Recall). This came on the heels of a proposal to issue a voluntary recall to 2.8 million owners in Germany, allowing them to decide on their own if they wished to have their cars repaired. This deal was rejected by the German Motor Transport Authority. Another 2,000 cars have been recalled in China.
In the United States, VW faces an eventual recall of 482,000 diesel vehicles. This will occur only after a repair has been tested and approved by the Environmental Protection Agency. Additionally, Volkswagen also faces fines of up to $37,500 per vehicle for violating the Clean Air Act. This could total as much as $18 billion, even before the first lawsuit is settled.
