The lawsuits filed by owners of VW CleanDiesel vehicles began almost as soon as Volkswagen admitted to installing the software that allowed many of their most popular models to cheat emissions testing allowing them to pass despite the fact that their actual level of emissions was much higher than the legal limits worldwide.

List of Exact Cars & Models Affected By Emissions Scandal

For drivers, the repercussions are just beginning. There is no fix in sight for these vehicles, and the resale value of these cars has tanked. You paid a premium when you purchased your car for the ability and were defrauded.

This scandal affects about 11 million Volkswagen owners of the following models worldwide:

    • 2010-2015 Audi A3
    • 2012-2015 Beetle and Beetle Convertible
    • 2010-2015 Golf
    • 2015 Golf Sportwagen
    • 2009-2015 Jetta
    • 2009-2014 Jetta Sportwagen
    • 2012-2015 Passat

List of Audi vehicles are affected:

    • A3 (2010 – 2015)
    • A6 (2016)
    • A8 (2016)
    • A8L (2016)
    • Q5 (2016)
    • Quattro (2016)

    Porche model:

    • Cayenne (2015)

It is unclear at present whether the vehicles can still meet EPA emissions standards with the device removed. Joining a class action lawsuit or filing individual litigation may be the only way Volkswagen owners can recover compensation for financial losses, as well as the non-economic toll caused by the diesel fraud scandal.

    What Is A "Defeat Device"?

The media has termed the illegal software installed by VW as a "defeat device," because it is designed to defeat the measures in place to ensure all vehicles meet federal and local guidelines for pollutants.

An infographic published at The New York Times explained exactly how Volkwagen was able to illegally circumvent emissions standards with the device, published in "How Volkswagen Got Away with Diesel Decpeption". The following image from the NY Times visual guide explains:

    Defeat Device via NY Times

This software detects when the vehicle is being tested for emissions and temporarily reduces the amount of nitrogen oxide emitted by the vehicle for the duration of the test.

Once the test is completed and the software detect normal road conditions, the pollution controls are automatically switched off. This gives the vehicle more power, but it also causes it to greatly exceed the acceptable level of nitrogen oxide emissions. In fact, in some cases, these cars can emit up to 40 times the legal limit of nitrogen oxide.

According to the U.S. Environmental Protection Agency (EPA.gov), the algorithm that lies at the heart of this software is "sophisticated." Based on this assessment, VW owners, lawyers and the general public alike can only assume that the devices must have been intentionally employed for the purpose of misleading tests for emissions performance.

The software analyzed a number of factors to determine if the engine control module should be running in "road calibration" or if there was a possibility the vehicle was undergoing testing for emissions output. By considering the vehicle's speed, the duration of time the engine was running, the position of the steering wheel and the barometric pressure, the software could switch out of road calibration when necessary, greatly increasing the effectiveness of the car's emission control system.

What Actions Have Been Taken To Correct The Issue?

Recalls of the affected diesel vehicles have occurred around the world, although there is currently little recourse for owners because a fix has yet to be implemented. While cars with a larger engine may require only a software update, those with the smaller 1.6-liter diesel engines must be adjusted manually, and retrofitted with new parts.

According to reports by the Associated Press (AP), it could be September 2016 before these parts are available.

In mid-October, Volkswagen announced plans to recall more than 8.5 million cars in Europe (Volkswagen Recall). This came on the heels of a proposal to issue a voluntary recall to 2.8 million owners in Germany, allowing them to decide on their own if they wished to have their cars repaired. This deal was rejected by the German Motor Transport Authority. Another 2,000 cars have been recalled in China.

In the United States, VW faces an eventual recall of 482,000 diesel vehicles. This will occur only after a repair has been tested and approved by the Environmental Protection Agency. Additionally, Volkswagen also faces fines of up to $37,500 per vehicle for violating the Clean Air Act. This could total as much as $18 billion, even before the first lawsuit is settled.

    Should I Be Worried?

There is no question that VW owners suffer a significant loss from this situation. There seems to be little hope of making the affected diesel engines comply with U.S. emissions standards without significantly impacting performance. This includes not only horsepower, but fuel efficiency -- two factors that drove many owners just like you to choose these vehicles in the first place.

Resale values of the affected cars have already taken a hit, and can be expected to fall further when VW applies the repairs and begins selling the diesels currently sitting at dealerships across the nation. It remains to be seen if any of the Volkswagen class action lawsuits filed will be able to recoup losses for owners. Chances are the 2017 year models will be rolling out around the same time, and those looking for a deal can buy a brand new 2015 for far cheaper than the sticker price.

The Consumer Fraud Case Against VW

Volkswagen advertised these vehicles as "CleanDiesel," claiming they offered the fuel-economy of a diesel engine but in a more environmentally-friendly way than traditional engines. To drivers, they seemed to live up to this hype. The fuel-economy was good, and they had the horsepower promised. This reverie ended abruptly for owners in September of 2015, however, when the EPA first described the illegal defeat devices (EPA).

Many owners of affected Volkswagens feel defrauded, and they have every reason to - you were tricked and lied to. The evidence shows that this wasn't simply a miscalculation or an oversight on the part of VW. Instead, it seems that Volkswagen may have intentionally committed fraud. Even once a fix is announced and implemented, owners will suffer. Their vehicles will no longer perform as well as they once did, and they were never all they were advertised to be.

Already, more than 40 class action suits have been filed in U.S. federal court. A number of individual suits have also been filed. While these lawsuits may become consolidated, there is no doubt that VW is facing a large payout. In addition to compensating owners for their actual economic and noneconomic losses, punitive damages are often rewarded when such a tortious act has been committed.
