In the lawsuit filed, the government alleged that GlaxoSmithKline pushed doctors to prescribe Advair as a first line therapy for patients with mild asthma, despite the fact that the drug was not approved for this use, nor was it medically appropriate in such cases. The government allegations also state the company paid doctors for prescribing and recommending their prescription medications. These payments came in the form of fees for speaking engagements, travel expenses, payments for being members of fake advisory committees, and other fraudulent payments.
A company spokesperson denied the allegations, saying there was no company strategy to unethically promote Advair and other products.
The GSK pharmaceutical company has claimed the settlement was reached in an effort to avoid delays, expenses and the inconvenience of lengthy litigation in the court system.
No doubt GlaxoSmithKline wanted to put these investigations and allegations behind them, considering independent research shows a connection between Advair and patient death (FDA), especially in cases where the drug was improperly prescribed to children.
According to an FDA researcher, from 2008 estimates that 14,000 deaths from 1994 through 2007 show a relationship to the use of long-acting beta-agonists such as Advair.
A separate analysis done by the private firm AdverseEvents Inc. estimates 1,900 deaths between 2004 and 2011 are linked to use of long acting beta-agonists and an additional 3,500 hospitalizations occurred during the same time period.

The DOJ case against GSK also outlined a number of criminal marketing practices, alleging unlawful promotion activities. Deputy Attorney General James M. Cole declaring the case an effort to "stop practices that jeopardize patients' health, harm taxpayers, and violate the public trust."

According to ProPublica, a consumer watchdog organization, GlaxoSmithKline paid a total of $400,000 to 9 of the panel members between 2009 and 2011.

A study done by Medco Health Solutions shows that doctors may be needlessly putting patients at risk by prescribing Advair and similar drugs to patients with mild asthma. In fact, many of the patients who have been prescribed these drugs have not even tried conventional steroid therapy.
